They are:
Prohibited Application Types:
1. Applications That Are distribute gold marketplaces for alternate content types (applications, games, themes etc..) Sold or OTHERWISE That Are Distributed Through Windows ® Marketplace for Mobile. 3. Applications that promote or link users to a website, or contain functionality within the application itself, which encourages or requires the user to purchase or pay to upgrade the application outside of Windows® Marketplace for Mobile.
4. Applications that enable VoIP (Voice over IP) services over a mobile operator network.
5. Applications that sell, link to, or otherwise promote mobile voice plans.
6. Applications that display advertising that does not meet the Microsoft Advertising Creative Acceptance Policy Guide http://advertising.microsoft.com/creative-specs
. 7. Applications that replace, remove or modify the default dialer, SMS, or MMS interface.
8. Applications that change the default browser, search client, or media player on the device.
9. Applications with an OTA (over the air) download >10 MB.
10. Applications that run code outside Microsoft runtimes (native, managed, and widgets)
11. Applications that publish a user’s location information to any other person without first having received the user’s express permission (opt-in) to do so, and that do not provide the user a means of opting out of having their location information published. 12. Applications that publish a user’s data from Their mobile device to personal Without Any Other HAVING Received The first user's express permission (opt-in) to do so, And That Do Not Provide The User has opted out of moyen de HAVING Their published data. A "user's data" includes, without limits, contacts, photos, SMS ou autres text communication, browsing history, location information, and Other Data Either Stored On The mobile device or Stored in the "cloud" attainable goal From The mobile device
We'll try to explain these 12 points in a most objective manner possible. Are prohibited on Marketplace:
1. Applications that compete with or provide MarketPlace selling applications, games or otherwise, already for sale on Marketplace.

2. Applications that are advertised for competitive solutions for Marketplace and selling applications on MarketPlace.
Same as clause 1.
3. Applications that propose, via a website or directly into the application, a feature upgrade fee.
Again, this is a protection clause of the MarketPlace, but also prevents the user to buy anything outside the Marketplace, with the risk that stock. It should be noted that this concerns only upgrades PAY.
4. Applications to make the VoIP network via the mobile operators.
This time, there is a clause protecting the mobile operators, which, it must be remembered, are Microsoft partners in the MarketPlace. However, it should be emphasized that this prohibition applies only to VoIP via the network operators (and therefore GSM/GPRS/EDGE/3G/3G +). We can therefore infer that applications like Skype that work via WiFi are welcome.
5. The applications offering packages of mobile telephony.
Again, protection for mobile operators.
6. Applications offering advertising not approved by Microsoft.
We can talk here to protect users against the advertising necessarily required. One can think of advertising for "adult".
7. Applications that modify, replace or remove the dialer or SMS and MMS interfaces.
Again, this clause can be there to protect the user and the mobile operator. The user, as an interface completely different from the original one can be confusing. Operators, for helping people not using the original products or set up by the operators (in the case of ROMs operators) is very difficult.
8. Applications that change the browser, media player or the search engine on the device.
This clause seems unreasonable. However, it will surely be applied in cases where the actual application changes any of the default without giving the choice to the user.
9. Download the applications is greater than 10MB / downloading applications over 10MB of data.
This clause is the most difficult to understand. It is either prohibit applications> 10MB or downloading applications elements> 10MB. However, it is doubtful that Microsoft is missing out on streaming applications.
10. Applications using nothing but managed code, native or Widgets.
This effectively bars the "small" applications based script.
11. Applications that publish the location information of the user without the express approval of it.
This condition is purely there to protect the user. Do not disclose such information without her knowledge is perfectly understandable.
12. Applications to retrieve user information without their express consent such as SMS, contacts, browser history ...
As the preceding clause, it is still protect the user.
It is also important to remember that even if an application is not approved by Microsoft for one of the reasons above, you can still install it by yourself. And yes, MarketPlace are not the only means of obtaining or installing an application. XDA-Developers Forum has a bright future.
